Vision Standard

FMCSA amends its regulations to permit individuals who do not satisfy, with the worse eye, either the existing distant visual acuity standard with corrective lenses or the field of vision standard, or both, to be physically qualified to operate a commercial motor vehicle (CMV) in interstate commerce under specified conditions. Currently, such individuals are prohibited from driving CMVs in interstate commerce unless they obtain an exemption from FMCSA. The new alternative vision standard replaces the current vision exemption program as the basis for determining the physical qualification of these individuals.

In a final rule published in the Federal Register on January 21, 2022, FMCSA amended its regulations to permit individuals who do not satisfy, with the worse eye, either the existing distant visual acuity standard with corrective lenses or the field of vision standard, or both, to be physically qualified to operate a commercial motor vehicle in interstate commerce under specified conditions. The document included an incorrect date for grandfathered drivers who participated in a vision waiver study program to come into compliance with the provisions in the final rule.

This 4-day course is designed to train individuals to prepare a legally sufficient enforcement case. Students will: • select the most appropriate and applicable violation • access and differentiate between Acute and Critical violations • demonstrate uniformity in the preparation of Enforcement Cases • provide appropriate supporting evidence • obtain FMCSA guidance and policy through e-FOTM • use standard language when completing enforcement cases • utilize computer software needed to prepare an enforcement case • use the appropriate Penalty Schedule to assess and assign a penalty amount

3rd Party CDL Testers 

Testing 

FMCSA proposes to allow States to permit a third-party skills test examiner to administer the Commercial Driver's License (CDL) skills test to applicants to whom the examiner has also provided skills training. Under this proposal, States would have the option to permit this practice, which is currently prohibited under FMCSA rules. The Agency believes that allowing States to permit this practice could alleviate CDL skill testing delays and reduce inconvenience and cost for third party testers and CDL applicants, without negatively impacting safety.

FMCSA amends its regulatory guidance to explain that FMCSA's current statutory authorities and regulations do not prohibit third party testers from administering the commercial driver's license knowledge tests for all classes and endorsements. SDLAs may accept the results of knowledge tests administered by third party testers in accordance with existing knowledge test standards and requirements set forth in 49 CFR part 383, subparts G and H.

Congress has charged the U.S. Department of 

Transportation (DOT) with regulating commercial motor vehicles (CMV) to promote the public interest in their safe operation, and to 

encourage economical, efficient, and fair transportation. The Federal Motor Carrier Safety Administration (FMCSA) is the operating administration within the DOT charged with ensuring “the highest degree of safety in motor carrier transportation.”3 Congress has instructed FMCSA “to improve motor carrier, commercial motor vehicle, and driver safety.”

FMCSA Report on Commercial Driver's License (CDL) Skills Testing Delays

This report analyzes the results of a national survey given to each State regarding their CDL skills testing programs. The survey gathered information on the length of testing delays, any State-mandated waiting periods (measured as distinct from a “delay”); third-party versus State resources; and the number of tests administered (including failures) as well as the number of cancelled tests.

Large Truck Crash Reconstruction for Prosecutors

Training

The website provides a link to a monograph designed to help prosecutors understand the factors that cause fatal large truck crashes. CMV crashes have their own distinctive factors and evidence. In addition, the dynamics of heavy trucks and some of the reconstruction methodologies are unique to CMVs. This is an overview for prosecutors who need a basic understanding of the dynamics of heavy trucks ,an appreciation for their operation compared to automobiles, and an understanding of evidence they may develop that can be used to reconstruct the pre-impact movement of the vehicle.
